Unipartner (UNIPARTNER) Garage Locator and Work Request

 By using the Website you agree to these Terms together with any additional terms, conditions, notices and disclaimers included on the Website, therefore please read these Terms carefully. If you object to any of these Terms (including any subsequent amendments or modifications) or become dissatisfied in any way in with your use of the Website, your only recourse is to discontinue usage of the Website.

OUR TERMS

1          OVERVIEW of the UNIPARTNER GARAGE LOCATOR AND WORK REQUEST

 1.1        The Website has been designed to enable you to identify local UNIPARTNER garages and submit a vehicle work request to a UNIPARTNER garage.

1.2        The UNIPARTNER Work Request process involves identifying your local UNIPARTNER/s (based upon information you submit via our Website or App) from which you select your preferred UNIPARTNER for the type of Service your Vehicle requires.  Any ultimate booking, Service or contract made is between you and the UNIPARTNER garage supplying the Work.  To use the Website you must agree to receive communications via email, text and/or phone from us and/or the UNIPARTNER garage to allow the UNIPARTNER Work Request to be submitted to and followed up by the UNIPARTNER garage.

1.3       When you make a UNIPARTNER Work Request, the chosen UNIPARTNER garage will be advised and your UNIPARTNER Work Request and contact details will be available to them, you will be sent a welcome email from Unipartner. Please make sure we are on your safe senders list and not filtered to junk mail. The UNIPARTNER garage will contact you and confirm all elements related to the Work Request. The Work is NOT confirmed until the UNIPARTNER garage and you have agreed this between yourselves.

1.4       We shall provide you with an option to request a courtesy car, when submitting UNIPARTNER Work Request, however, you will need to check with the individual UNIPARTNER garage to establish Vehicle collection and courtesy car options and any ensuing insurance requirements.

1.5       By booking a Service with the UNIPARTNER garage you are agreeing to the outlined Servicing Schedules (detailed within the “What’s Included” on the Unipartner Website or App) relevant to the Service you have selected. The cost of all Service and additional work, following a Service and/or survey of your Vehicle by the UNIPARTNER garage, must be agreed between you and the UNIPARTNER garage.

1.6       The contract for any Work offered over the Website or App or with the UNIPARTNER garage during repairs is solely between you and the UNIPARTNER garage. You will pay the UNIPARTNER garage directly for all works undertaken in the normal way under their terms and conditions of business. We charge the UNIPARTNER garage a referral fee for Work requested through the Website or the App.

1.7       All costs are subject to VAT as required by UK law, all Website or App prices quoted are inclusive of VAT.

1.8       If you need to cancel or revise the date of your Work, please contact the UNIPARTNER garage directly. It is really important as the UNIPARTNER garage will be expecting you and will have allocated a person to work on your Vehicle.

1.9       We are not liable for:

(i)         Any transactions, disputes, Work and/or bookings made between the UNIPARTNER garage and you however they may have occurred including but not limited to any introduction over the Website.

(ii)        The nature or suitability of any agreed or offered Work by the UNIPARTNER garage or over the Website or App, nor the suitability of a UNIPARTNER garage in providing the Work offered.

You acknowledge and accept that you release us from any liability, claim or damages of any kind that may arise from you using either the Website, App or Services.

1.10     Should any complaint arise following car servicing performed by a UNIPARTNER garage, raise the compliant directly with the UNIPARTNER garage, if the compliant is not dealt with to your satisfaction, the compliant can be raised to the Motor Ombudsman: https://www.themotorombudsman.org/consumers.

2          DEFINITIONS AND INTERPRETATION

 Work/s” means (but not is limited to) any automotive service delivery, MOT, maintenance, parts, accessories or repair performed by the UNIPARTNER garage;

Servicing Schedules” means a set of agreed servicing items that will be conducted by a UNIPARTNER garage;

Terms” means these terms as amended from time to time;

UNIPARTNER” means an independent garage that is part of the Unipartner network;

UNIPARTNER Work Request” means the process by which you use the Website or App to search, obtain a price, select a UNIPARTNER garage and time for delivery of Work to be confirmed by the UNIPARTNER garage.

Vehicle” means a road vehicle that has four wheels and is powered by an internal-combustion engine.

We”/”us”/”our” means UNIPART GROUP LIMITED (trading as UNIPART AUTOPARTS) a company registered in England and Wales. Our company registration number is 576777 and our registered office is at Unipart House, Cowley, Oxford OX4 2PG. Our registered VAT number is GB 448 576 309. 

Website” includes www.unipartner.com and any other website address established in substitution for that address;

App” includes Unipartner Mobile Application and any other mobile Application established in substitution for that Application;

"You" or “your” is reference to any person using the Website or App 'You', who has visited and/or used the Website or App who seeks and/or makes a UNIPARTNER Work Request;

3.         OUR RIGHTS TO MAKE CHANGES TO THE TERMS AND THE WEBSITE

3.1       We may need to change the Terms from time to time for a number of reasons (including to comply with applicable laws and regulations and regulatory requirements). Changes may be made at any time and you are advised to review the Terms on a regular basis. The most up to date Terms will be available on the Unipartner Website. If any change is unacceptable to you, you should cease using the Website or App [and/or close your account]. If, however, you continue to use the Website or App after the date on which the changes to the Terms come into effect, you will be deemed to have accepted those changes.

3.2       We may need to change the Website or App from time to time.  We reserve the right to take such action as we consider necessary in relation to the Website or App, including but not limited to revising the contents and withdrawing the Website or App in its entirety.

4.         PERSONAL DETAILS

4.1       We comply with data protection legislation, including the General Data Protection Regulation (GDPR). By using our Website or App you agree to the collection, use and transfer of the personal information you provide to us in conjunction with the terms of our Privacy Policy and Cookie Policy. 4.2       To use the UNIPARTNER Work Request facility you must agree to receive communications via phone, text and/or email from us and the UNIPARTNER garages to allow your UNIPARTNER Work Request to be submitted.

4.3       How we will use your personal information. We will use the personal information you provide to us (detailed in Clause 4.4) to submit your UNIPARTNER Work Request and create an account for you. 

4.4       What personal information we process.  To process the UNIPARTNER Work Request we will need certain information from you and/or may need to contact you about your UNIPARTNER Work Request.  The information we will need to process your UNIPARTNER Work Request is: your name, vehicle registration number (on the website you will be asked to confirm make/model of your Vehicle so that we can more accurately link your Vehicle to the Servicing Schedules), preferred location to identify local UNIPARTNER options for you to select a preferred garage, email address and telephone number.  On the website we will not pass any personal details to a UNIPARTNER garage until a UNIPARTNER Work Request is made, these details will be available to the UNIPARTNER garage while you have a website account linked with that UNIPARTNER garage. We need to pass on these personal details to the UNIPARTNER garage to enable the UNIPARTNER garage to correctly identify you and the UNIPARTNER Work Request and make contact with you to confirm the details of your requirements. If you give us incomplete or inaccurate information, we cannot submit the UNIPARTNER Work Request.

4.4       We will only give your personal information to third parties who are not detailed in our Privacy Policy where the law either requires or allows us to do so.

5.         USE OF THE WEBSITE OR APP

 

5.1       All person(s) using our Website should be at least 18 years of age and reside in the UK.

5.2       We may terminate your use of the Website or App and or cancel any UNIPARTNER Work Request without notice or reason but particularly (but not limited to) the following:

(i)         the information provided by you is incomplete, invalid, untruthful or incorrect;

(ii)        you use the Website to send spam;

(iii)       you provide false information about your identity;

(iv)       you do not agree to receive communications from us and/or the UNIPARTNER garage in relation to any UNIPARTNER Work Request.

5.3       We provide the Website to give you the opportunity to locate and link with UNIPARTNER garages and submit a UNIPARTNER Work Request.

5.4       We are not directly involved (whether as agent or principal) in any transactions between you and a UNIPARTNER garage.

5.5       We do not guarantee that you will be able to book your required Work with a UNIPARTNER garage.

5.6       The submission of a UNIPARTNER Work Request on the Website or App is not a contract for the UNIPARTNER garage to provide any Service/s.

5.7       Prices displayed on the Website or App may not be accurate. Following submission of a UNIPARTNER Work Request, you must agree prices with the UNIPARTNER garage on confirming the Work with the UNIPARTNER garage.

5.8       We cannot and will not make enquiries as to the nature, suitability, or quality of any Work provided by any UNIPARTNER garage nor the accuracy of any description of the activity, price, feedback, technical ability or the ability of a UNIPARTNER garage to complete any transaction.

6.         WARRANTIES AND INDEMNITIES

 6.1       All information provided by you when making a UNIPARTNER Work Request is provided in order for the Website to provide an estimated price, using Servicing Schedules and for the UNIPARTNER garage to undertake Work to your Vehicle.  You warrant that all information provided by you via the Website or App is true and accurate and that no information given or omissions made by you is intended or likely to mislead or deceive any person or organisation. We reserve the right at our discretion to request verification of, or verify on your behalf, any information provided by you.

6.2       You acknowledge that you have not relied upon or been induced by any representation by us and that we make no warranty or representation as to:

(i)         the results that may be obtained through the use of the Website or App;

(ii)        the accuracy, reliability or otherwise of any information obtained through the Website or App;

(iii)       the Website or App being uninterrupted, timely or error free;

(iv)       the services purchased or obtained through the Website or App.

6.3       You indemnify and keeps us indemnified and our officers, employees, agents, subsidiaries and affiliates against all claims (including third party claims), demands, damages, costs (including legal costs), penalties or suits arising out of or consequential upon:

(i)         the use of the Website or App;

(ii)        any dispute between you and a UNIPARTNER garage;

(iii)       any negligence by a UNIPARTNER garage in the provision of the Work;

(iv)       any loss or damage suffered by you arising from or related to the provision of Services;

(v)        any loss or damage suffered by you arising from or related to the use of the Website or App.

7.         LIMITATION OF LIABILITY – EXTENT OF LIABILITY

7.1       You acknowledge that we have no liability to you in relation to any the Website, UNIPARTNER Work Request and/or provision of the Services. You release us from all and any claims arising out of or consequential upon:

(i)         the use of the Website or App;

(ii)        any dispute between you and a UNIPARTNER garage;

(iii)       any negligence by a UNIPARTNER garage in the provision of Services;

(iv)       any loss or damage suffered by you arising from or related to the provision of the Work;

(v)        any loss or damage suffered by you arising from or related to the use of the Website or App.

7.2       You acknowledge that the internet can be unstable and, sometimes, insecure. At times the Website or App may not be available or UNIPARTNER Work Requests may not be processed or may not be accepted. In these circumstances we accept no responsibility.

7.3       We give no warranty in relation to the Website or App. Under no circumstances are we or any of our carriers or suppliers liable or responsible in any way to you or any other person for any loss, damages, costs, expenses or other claims (including consequential damages and loss of profits or loss of revenues), howsoever caused, including as a result, direct or indirect of any defect, deficiency or discrepancy in the Website or App including its form, content and timeliness of delivery.

7.4       We may still be liable for:

(i)         death or personal injury arising from our negligence;

(ii)         fraudulent misrepresentation;

(iii)         any other liability which cannot be excluded or limited under applicable law.

 

8.         OTHER IMPORTANT TERMS  

8.1       We may transfer this agreement to someone else. We may transfer our rights and obligations under these Terms to another organisation.

8.2       Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of these Terms.

8.3       If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

8.4       Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

8.5       Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.

8.6       By using and/or visiting any section (including sub-domains) of our Website or any other websites or applications that we own and/or registering on the Website, you agree to be bound by (i) these Terms; (ii) our Privacy Policy; (iii) our Cookie Policy and (iv) the rules applicable to the services we offer, and are deemed to have accepted and understood all the Terms.
